Terms and conditions (AGB)

These terms govern the use of exablo.com and the Exablo exam simulator at app.exablo.com.

1. Scope

These terms apply between the provider named in the Impressum ("we") and you as a user of the website exablo.com and the application app.exablo.com ("the service").

Terms of your own that conflict with these do not apply unless we have agreed to them in writing.

2. What the service is

Exablo provides simulations of language and professional examinations, practice modes for individual exam sections, and automated assessment of answers, including assessment produced with the assistance of artificial intelligence.

What the service is not. Exablo is an independent preparation tool. We are not an examination board and we do not issue any recognised certificate. We are not affiliated with, endorsed by or certified by telc, the Goethe-Institut, TestDaF or any other exam provider.

No guarantee of results. Scores and feedback produced by the service are an estimate intended to guide preparation. They are not a prediction of your result in an official examination and confer no entitlement of any kind. Automated assessment can be wrong.

3. Registration and accounts

Using the simulator requires an account. You must provide accurate information and keep your credentials confidential. Accounts are personal and may not be shared or transferred.

You must be at least 16 years old to register, or have the consent of a parent or guardian.

4. Formation of contract

Presenting products on the site is not a binding offer. A contract is formed when you complete the purchase process and we confirm the order by email.

5. Prices and payment

All prices are shown in euros and include statutory VAT where applicable. The price displayed at the time of ordering applies.

Payment is processed by our payment service provider. We do not store full payment card details.

6. Availability

We aim for high availability but do not warrant that the service will be uninterrupted or error-free. Maintenance, updates and causes beyond our control may cause temporary unavailability.

We may change or discontinue features. Where a change materially reduces what you have paid for, we will tell you in advance and offer a proportionate remedy.

7. Acceptable use

You may not:

  • share, resell or publish exam content obtained through the service;
  • use automated means to extract content in bulk;
  • attempt to circumvent access controls or usage limits;
  • use the service to infringe the rights of others or to break the law.

We may suspend or terminate access for serious or repeated breaches.

8. Intellectual property

All content of the service is protected by copyright and remains our property or that of our licensors. You receive a non-exclusive, non-transferable right to use the content for your own preparation for the duration of your access.

9. Right of withdrawal

Consumers have a statutory right of withdrawal. See the separate Right of withdrawal page, which forms part of these terms.

10. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health.

For slight negligence we are liable only where a material contractual obligation is breached - an obligation whose fulfilment makes proper performance possible and on whose observance you may regularly rely - and then only for damage that is foreseeable and typical of this kind of contract.

Liability under the German Product Liability Act remains unaffected.

11. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the EU, this choice does not deprive you of the protection of mandatory provisions of the law of your country of residence.

12. Changes to these terms

We may amend these terms where there is a valid reason, such as a change in the law or in the service. We will notify you at least 30 days before a change takes effect. If you object within that period, either party may terminate the contract.

13. Severability

If any provision is or becomes invalid, the remainder stays in force.
